Continuity, stability seen as crucial to constitutional amendment process in Belarus

The proposals to amend the country's basic law should rely on the cohesion of the constitutional development process, continuity and stability, Chairman of Belarus Constitutional Court Piotr Miklashevich told the media, BelTA has learned.

Piotr Miklashevich noted that those who are working on the proposals should bear in mind that the Constitution is an overarching document that comprehensively regulates legal relations in the society and the state. “Here it is important to ensure the cohesion of the constitutional development process, continuity and stability. The constitutional amendment proposals should rely on these principles,” he said.

The chairman of the Constitutional Court recalled that the basic law of Belarus was developed in a difficult period when the country was in transition from the Soviet political and social system to new forms. Time has shown that the Constitution developed back then gave the country the possibility to ensure stable and sustainable development of the society and the state for 25 years. However, constitutional development continues, with public relations gradually changing. With that in mind, the head of state signaled the need to adjust certain provisions of the Constitution.

The Constitutional Court has been working on this, doing a comparative research of the constitutional provisions of other countries. Piotr Miklashevich stressed that the Constitution of Belarus should be “adjusted to keep up with today's social and political realities.”

Minsk is hosting a two-day international conference “Modern Constitutional Development: the Role of Constitutional Control in Constitutionalization of Law”. The conference is marking the 25th anniversary of the Constitution and the establishment of the Constitutional Court in Belarus. Attending the forum are delegations of the constitutional courts of Azerbaijan, Armenia, Bulgaria, Bosnia and Herzegovina, Georgia, Kazakhstan, Kyrgyzstan, Latvia, Russia, the Czech Republic, representatives of the European Commission for Democracy through Law (Venice Commission), MPs, and scientists.
